These Terms of Sale apply to all purchases of FURIA Élan Series products, accessories and installation services in Australia. By ordering, you agree to these Terms in addition to your non-excludable rights under the Australian Consumer Law (ACL).
1. Parties, scope and acceptance
The supplier of the products is Nouvelle Hair and Beauty Supplies (NHBS) trading as FURIA Élan Series, showroom and dispatch from 12 Smolic Court, Tullamarine VIC 3043 (we, us, our). These Terms govern quotations, orders, deliveries and services provided by us in Australia.
Your order is an offer to purchase. We may accept or reject any order. Acceptance occurs when we issue an order acknowledgment, process payment, or dispatch the goods, whichever happens first.
To the extent of any inconsistency, these Terms prevail over your purchase terms. Nothing in these Terms limits your rights under the ACL.
2. Quotations, pricing and payment
- Quotes: Written quotes are valid for the period stated or 14 days if no period is stated.
- Prices: Prices are in AUD and inclusive/exclusive of GST as indicated. We may correct typographical errors or obvious mistakes without liability.
- Payment: We accept the payment methods advertised at checkout. Orders may require a deposit or full prepayment. Goods remain our property until paid in full (clause 16).
- Security: Online payments are processed by third-party payment providers. We do not store full card details.
3. Delivery, express shipping and risk
- Australia-wide express: We dispatch nationwide using reputable carriers. Tracking is provided where available. Delivery windows are estimates and may vary due to carrier operations, access or events beyond our control.
- Risk & title: Risk in the goods passes on delivery to your nominated address or collection point. Title passes only on full payment (see clause 16).
- Access: You must ensure safe and reasonable access for delivery, including parking, door width, lift access and floor protection. If delivery is missed or access is restricted or unsafe, redelivery or additional handling fees may apply.
- Inspection on arrival: You must visually inspect on delivery and notify us of transport damage within 48 hours with photos.
4. White-glove installation (Melbourne)
Within Melbourne metro we offer a white-glove service that typically includes: delivery to room, positioning, height/level adjustment, basic control demonstration and removal of packaging. Unless stated otherwise in writing, white-glove service excludes electrical works, structural modifications, carpentry, mounting into walls/floors, stair carries beyond reasonable OH&S, and removal of existing furniture or fixtures.
Safety & access: You are responsible for providing a safe environment and clear access. We may refuse or suspend service if conditions are unsafe (e.g., wet floors, obstructed access, exposed wiring). Additional charges may apply for non-standard access, excessive stairs, after-hours attendance or failed appointments.
Demonstration & handover: We provide a basic demonstration of controls. You are responsible for ensuring staff who operate the bed are trained and competent.
5. Professional use and suitability
FURIA beds are professional treatment equipment designed for trained practitioners. You are responsible for clinical protocols, hygiene, and ensuring suitability for your intended treatments and client population. We do not provide clinical advice and make no representation that a product is suitable for any specific medical condition or procedure.
Where required by local laws or premises policies, you must obtain approvals or certifications before use.
6. Specifications, finishes and changes
We may make minor technical or cosmetic changes that do not materially affect performance. Dimensions are approximate. Colours and textures may vary due to batch variance and display calibration. Unless expressly guaranteed, finishes are not guaranteed to match other furniture.
7. Care, upholstery and maintenance
- Use approved cleaners only. Avoid harsh solvents, bleach, abrasives and undiluted alcohol.
- Prevent dye transfer from dark garments, cosmetics and disinfectants.
- Avoid direct sun and heat sources to reduce fading or cracking.
- Periodically check fasteners and moving parts. Stop use if abnormal noise, vibration or damage is observed and contact support.
Damage from misuse, improper cleaning or neglect is not a defect.
8. Electrical and compliance
Our motor systems are EMC-tested to applicable standards and intended for use with properly grounded Australian mains power. Use only approved accessories. Do not open casings, bypass safety features or modify wiring. We recommend surge protection in clinics subject to power fluctuation. Electrical works, if any, must be performed by licensed electricians.
9. Accessories and compatibility
Optional accessories (e.g., foot controls, headrests, armrests) must be fitted and used according to instructions. You are responsible for correct configuration for your treatments and environment.
10. Handling, installation and movement risk
Products are heavy. Use appropriate lifting methods and floor protection. Movement of beds after delivery is at your risk. We are not responsible for building, floor or wall damage caused by movement or misuse outside our service scope.
11. Warranty (two-year back-to-base)
We warrant that products will be free from defects in materials and workmanship for two (2) years from delivery (the Warranty Period), on a back-to-base basis. We may repair, replace or refund (at our option) after assessment.
Exclusions: wear and tear; cosmetic changes; damage from misuse, improper cleaning, liquids, unauthorised repairs or modifications; power surge or improper power; failure to follow instructions; non-FURIA accessories; commercial abuse.
Process: lodge a claim with proof of purchase, photos and description. We may request return to our service centre for assessment. If no defect is found or the issue is excluded, you are responsible for freight and service fees.
Your rights under the ACL are in addition to this warranty and cannot be excluded. If a failure is major, you are entitled to a replacement or refund. If a failure is minor, you are entitled to a repair within a reasonable time.
12. Returns and change of mind
- Change of mind: accepted only at our discretion within 14 days of delivery. Goods must be unused, in original packaging and resaleable condition. Restocking fees and return freight at your cost may apply.
- Authorisation: do not return goods without a written return authorisation number.
- Custom or special-order items are not returnable unless defective under ACL.
13. Service, call-outs and out-of-warranty repairs
Out-of-warranty service, on-site call-outs, non-standard installations and user-induced faults are chargeable. We will advise rates and obtain your approval before proceeding.
14. Limitation of liability
To the extent permitted by law, we exclude all implied conditions and warranties not expressly stated in these Terms. Our liability for any claim arising from the goods or services is limited, at our option, to replacement, repair, resupply, or payment of the cost of doing so. We are not liable for indirect or consequential loss, loss of profit, revenue, business or anticipated savings.
Nothing in these Terms limits liability for personal injury or death caused by proven negligence, or your non-excludable rights under the ACL.
15. Indemnity
You indemnify us against claims, losses, damages, costs and liabilities arising from: misuse or unauthorised modification of products; unsafe premises or access; failure to follow instructions; breach of law or these Terms; and third-party claims resulting from your use of the products or services.
16. Retention of title
Title to goods remains with us until paid in full. Until title passes, you must keep goods in good condition, separate and identifiable as our property, and not create any security interest over them.
17. Website use and intellectual property
All content, logos, imagery and code on our websites are protected by intellectual property laws. You must not copy, reverse engineer or misuse any content. Information on the website is for general guidance; specifications may change without notice. In the event of a discrepancy, your order acknowledgment prevails.
18. Force majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control, including carrier disruption, strikes, epidemics, natural disasters, acts of government or shortage of components.
19. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia. The parties will use good-faith efforts to resolve disputes. If unresolved, the courts of Victoria have non-exclusive jurisdiction.
